المستشار محمود حمزه يتنحى عن نظر الاستئناف المقدم من الصحفيه بقناة الجزيره هويدا طه والتى اعتقلت بسبب تصوير افلام وثائقيه عن التعذيب واعمال القمع ضد المصريين على ايدى الشرطه المصريه
وقال القاضى لفرانس برس "انه لا يستطيع الحكم في قضية بهذه الحساسية نظرا لموقفه من الحكومة
و القاضي محمود حمزة فهو من القضاة الذين ناضلوا من اجل استقلال الجهاز القضائي خلال حملة الانتخابات الرئاسية عام 2005.
وفي عام 2006 تعرض حمزة للضرب على يد الشرطة خلال تظاهرة ضد الدعاوى التي رفعتها الحكومة على اثنين من القضاة
